2. Scope
These Terms and Conditions of Sale apply, without restriction or reservation, to every order placed on rimcrew.com by a consumer. Validating an order constitutes full and entire acceptance of these terms, which the customer acknowledges having read before payment. Rim Crew may amend the terms at any time; the applicable version is the one in force on the day of the order.
3. Products — made to order
Rim Crew sells custom wheel hubcaps, available in several sizes (12 to 17 inches) and sold exclusively in sets of 4, one per wheel. Every hubcap is made to order, from the artwork supplied by the customer or the design chosen from the catalogue when ordering: there is no stock, production starts once the order is confirmed.
The photographs and visuals on the site are as faithful as possible but do not form a contractual document: slight variations in shade may exist between the on-screen preview and the printed product.
The size of a hubcap depends on the wheel (the number after the “R” on the tyre sidewall), not on the vehicle model. It is for the customer to check their size before ordering — the site's fitting & sizing guide explains this, and our support answers before purchase if in doubt.
4. Artwork supplied by the customer
By sending an image for personalisation, the customer declares and warrants:
- that they hold the necessary rights to that artwork (own work, royalty-free image or authorisation from the rights holder);
- that the artwork does not infringe third-party rights (copyright, trade marks, image rights) and is not unlawful, defamatory, hateful or contrary to public policy.
Rim Crew reserves the right to refuse and refund any order whose artwork breaches these rules. The customer is solely responsible for the artwork they supply and indemnifies Rim Crew against any third-party claim in that respect.
5. Prices
Prices are shown in euros (EUR), including all taxes. The applicable VAT is that of the delivery zone. Delivery costs are not included: the exact amount, calculated according to destination and number of items, is displayed at the payment step, before the order is validated. For deliveries outside the European Union, customs duties and local taxes may be payable on receipt; they remain the responsibility of the recipient.
6. Ordering
Ordering takes place online: choice of product (size, quantity, artwork), adding to basket, entering delivery details, choice of delivery method, then payment. A confirmation email summarising the order is sent after payment. Rim Crew reserves the right to refuse an order on legitimate grounds, in particular suspected fraud, a previous dispute or artwork that does not comply with article 4.
7. Payment
Payment is due immediately on ordering. It is made securely by bank card via Stripe, by Apple Pay or Google Pay, or via PayPal. No banking data is stored by Rim Crew. The order is only processed once payment has actually been received.
8. Delivery
Products are manufactured then shipped from our logistics partners' workshops, with a tracking number sent by email as soon as they leave. The zones served, the delivery methods offered (from the most economical to the fastest) and indicative timescales by destination are set out in our delivery policy, and the timescale for the chosen method is repeated at the payment step.
In the event of significant delay, the customer may contact us; in accordance with articles L216-6 et seq. of the French Consumer Code, if the trader has not delivered within a further reasonable period set by the consumer, the consumer may request cancellation of the order and a refund. If a parcel is visibly damaged on receipt, we recommend registering reservations with the carrier and contacting us with photos.
9. Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the consumer has in principle 14 days from receipt to withdraw from a distance purchase.
Exception applicable to all our products: pursuant to article L221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalised. All hubcaps sold on the site are made to order, after the order is placed, according to the customer's choices (size and artwork, whether an image supplied by the customer or a design chosen from the catalogue): they fall into this category and can be neither taken back nor resold.
The customer is informed of this before validating their order and expressly accepts it. In return: as long as production has not started, the order can be cancelled and refunded in full on a simple email to contact@rimcrew.com.
10. Statutory guarantees
Independently of any commercial warranty, Rim Crew is liable for lack of conformity and hidden defects in the products sold, under the conditions set out below.
Statutory information box (article D211-2 of the French Consumer Code):
The consumer has a period of two years from delivery of the goods to obtain the benefit of the statutory guarantee of conformity where a lack of conformity appears (articles L217-3 to L217-20 of the French Consumer Code). For twenty-four months from delivery of the goods, the consumer need only establish the existence of the lack of conformity, and not the date it appeared. The statutory guarantee of conformity requires the trader, where applicable, to provide all means necessary to bring the goods into conformity. The consumer may choose between repair and replacement of the goods, subject to the cost conditions laid down in article L217-12 of the French Consumer Code. If the goods are neither repaired nor replaced, the consumer may obtain a price reduction or cancellation of the contract under the conditions laid down in articles L217-14 et seq. The statutory guarantee of conformity applies free of charge for the consumer. The consumer also benefits from the guarantee against hidden defects within the meaning of articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect; it allows them to choose between cancellation of the sale and a price reduction.
Personalisation of the product does not stand in the way of these guarantees: a hubcap that is faulty, damaged on arrival or not as ordered is replaced or refunded.
11. Rim Crew commercial warranty
In addition to the statutory guarantees, Rim Crew undertakes that any fault reported within 30 days of delivery, with photo or video evidence, gives rise to a free replacement or to a refund, with no prior return required. This commercial undertaking in no way limits the consumer's statutory rights described in article 10. The practical arrangements are set out in our returns & warranty policy.
12. Personal data
The data collected when ordering is necessary to process it (manufacture, delivery, invoicing) and is processed in accordance with our privacy policy. The customer has in particular rights of access, rectification and erasure, exercisable at the address contact@rimcrew.com.
13. Intellectual property
All elements of the rimcrew.com site (brand, logo, text, photographs, designs) are protected by intellectual property law and remain the exclusive property of Rim Crew. The customer retains ownership of the artwork they supply; they grant Rim Crew the right to reproduce it for the sole purpose of manufacturing their order.
14. Liability — force majeure
The products are cosmetic accessories: it is for the customer to make sure they are properly fitted before driving, in accordance with the fitting guide. Rim Crew cannot be held liable for failure to perform its obligations in the event of force majeure within the meaning of article 1218 of the French Civil Code, nor for damage resulting from improper use or fitting.
15. Complaints and disputes
In the event of a complaint or dispute, the customer contacts customer service (contact@rimcrew.com); Rim Crew will seek an amicable solution with the customer.
16. Applicable law
These terms are governed by French law, without prejudice to more protective mandatory provisions of the consumer's country of residence within the European Union. Failing amicable resolution, the dispute is brought before the competent courts under ordinary law.
